Incident Date: 2008-09-07 12:01:01 Address: 206 HENDERSONVILLE RD Suspect entered the parking lot of Mountain Energy in a white two-door Toyota compact car, possible an older Celica. Suspect entered the store and went straight to the beer cooler. He removed a case of Budweiser and a case of Bud Light and walked out the door. The store clerk attempted to get the tag number, but it was covered up by a piece of cardboard with a middle finger drawn on same. Suspect was a white male, approximately in his mid-20s and about 5`10, with dark brown hair. He was wearing a white T-shirt and blue jeans.
Incident Date: 2008-09-07 12:01:01 Address: 779 BILTMORE AVE Suspect entered the CitiStop service station and a witness told police that he grabbed two cases of Bud Light and left without paying for the items. The unknown suspect then left in an unknown vehicle.
Incident Date: 2008-09-03 12:01:01 Address: 160 TUNNEL RD Suspects went to Mack Kells resturant on Wednesday evening Sept. 3 and consumed $85.64 worth of food and alcoholic beverages. They then attempted to leave without paying. Employees tried to stop the suspects from leaving and, according to the employees, the suspects assaulted them while trying to leave the building. The business took out warrants for Defrauding an Innkeeper, but declined to press charges on the assault. All three suspects were taken to the Buncombe County Detention Center, where they were served with the warrants.
Incident Date: 2008-08-28 12:01:01 Address: 9 WEDGEFIELD DR A Super 8 Motel manager told police that the front desk cash drawer was short on two straight days. After noting that the money was missing, the manager repositioned the front desk security camera to point directly at the cash drawer. On 8/28/2008 at about 3 p.m., the camera recorded the suspect opening the drawer and removing cash.
Incident Date: 2008-08-25 12:01:01 Address: 675 PATTON AVE At about 5:30 a.m. on Aug. 25, a suspect was pulled over on a routine traffic stop after a reporting party said they witnessed him in the Denny`s parking lot, possibly with a gun. Patrol officers saw the car traveling on Patton Avenue near Pearl Street and conducted the stop. Officers observed that the above suspect had a strong odor of alcohol on his breath, conducted a field sobriety test, and arrested the suspect for DUI. After a inventory search of the vehicle, an officer located a clear plastic bag containing a white powdery substance believed to be Schedule II. Arrested was Dwayne Ruth, birth date 10/25/1984.
Incident Date: 2008-08-21 12:01:01 Address: 100 TUNNEL RD AT: 36 On Aug. 21 at 8:07 a.m., officers were dispatched to 100 Tunnel Road in reference to a common law robbery. The victim said he opened his front door at approximately at 7:55 to leave for breakfast, at which point two white men grabbed him and pushed him into the room. The suspects then allegedly held the man down on the bed, covering his mouth with their hands. They went through his pockets, taking several hundred dollars from him. The suspects then ran outside and left in a silver four-door vehicle. The victim was not injured.

Unknown subject(s) set a fire in the downstairs bathroom of the business while it was open. Report secured for fire marshal. No injuries.

French Broad Ave. and robbed them of two purses and a cellphone. According to the victims, the suspect had a handgun. The incident remains under investigation.

Incident Date: 2008-07-22 12:01:01 Address: 800 BROADVIEW DR An officer responded to a call of an assault at 114 Wood Ave. The victim said that he was riding his scooter down Broadview Road when he was flagged down by the offender.The victim told police that the offender acted as though he was going to say something, but instead and struck him in the mouth. The victim also stated that the offender left the scene in an unknown direction. The victim refused medical attention. The offender was located and charged with Simple Assault by citation and driven home to be remanded back to his parent's custody.

He was rolling around on the ground, spitting blood. He was transported to Mission Hospitals by EOC. EMTs stated that they did not believe he had life threatening injuries.Officers charged Joshua Nathaniel Norton, birth date 7/29/1982 with Felony Assault Inflicting Injury. bond was set at $10,000 unsecured.
Incident Date: 2008-06-29 12:01:01 Address: 1 RESORT DR ASHEVILLE - At 9:52 a.m. June 29, hours an APD officer took a Breaking & Entering report and a Larceny report at 1 Resort Drive in reference to a missing golf cart. At 12:14 p.m, APD received a call of a civil dispute at room 39-A over a golf cart. Officers responded, located the cart and it was the same. Arrested and charged were Randall Nathan Light, birth date 6-14-1984, for Felony B&E and Larceny. He was placed under a $5,000 secured bond. Hotel representatives were called, retrieved their property and said they were very thankful.
Incident Date: 2008-06-19 12:01:01 Address: 219 MERRIMON AVE ASHEVILLE - An APD officer initiated a vehicle stop at 219 Merrimon Ave., on June 19, which resulted in the arrest of the driver, Zundra Deborah King, birth date 09/17/1973, on an outstanding warrant for Public Assistance Fraud. She was released on a written promise to appear in court. Her passenger, Tommy Theodis Garrett Jr., birth date 5/13/1979, was also arrested on two outstanding warrants for Misdemeanor Probation Violation. A search incident to arrest resulted in the seizure of two dosage units of Ecstasy and a subsequent charge of Felony Possession of a Schedule I drug. Bond was set at $11,000 secured.
Incident Date: 2008-04-27 12:01:01 Address: 32 N MARKET ST Report of fight with weapons in progress at 32 N Market St. at 2:20 a.m. Three victims were assaulted by a suspect with a knife. Officers arrived to find two subjects on the ground with severe lacerations and puncture wounds. A third victim was located with a laceration to neck. EMS responded and transported the two subjects that were on the ground to Mission Hospitals. The third subject was taken by personally owned vehicle to Mission for treatment. CID, ID, and all patrol responded to scene. Due to cooperation from officers, detectives, and communications a suspect was identified and warrants obtained. Search for suspect James Ira Milling III continues at this time.
Incident Date: 2008-04-24 12:01:01 Address: 165 COLEMANE AVE AT: 12 Stabbing reported near the 12 building of Woodcroft Apartments. The victim was stabbed in the hand and transported to the hospital with non-life threatening injuries. Officer Edmonds located the suspect (Stacey Dawn Siebert, B/F, 09/28/77). Ms. Siebert was charged with Assault With a Deadly Weapon Inflicting Serious Injury. Bond set at $2,500 secured.
Incident Date: 2008-04-19 12:01:01 Address: 1296 PATTON AVE APD officer found a vehicle in parking area on Grove Street and Hillard Ave which was in the system as stolen. Owner came and recovered the vehicle, no suspects were found around the vehicle.
Incident Date: 2008-04-03 12:01:01 Address: 990 W CHAPEL RD APD Officer Josh Burleson located a suspicious vehicle at 990 W. Chapel Road in Shiloh and subsequently located Melissa Kris White, birth date 4/18/78, outside of her vehicle. After a consent search, the officer found 1 gram crack cocaine in her vehicle, 5 grams of marijuana and multiple pieces of drug paraphernalia. White was placed in the Buncombe County Detention Center under a $1,500 secure bond. White had stated she was in Shiloh to buy crack cocaine, which led to consent search of the house and shed at 990 W. Chapel Road. The search yielded 18 pieces of drug paraphernalia. Larry Edward Johnson, birth date 1/17/54, was charged with possession and possession with intent to use drug paraphernalia.
Incident Date: 2008-03-29 12:01:01 Address: 52 BLAKE DR Two APD officers responded to 52 Blake Drive in reference to a call regarding a breaking and entering in progress on March 29. The police department has responded to this residence numerous times in the past on domestics involving Robert Lee Shugars, black male, birth date 07/16/1952. When officers arrived at the front door, the glass was broken out and no one responded to officers' announcement that they were on the premises. Officers gained entry to the residence to check on the welfare of the female resident and did a room to room search. Officers found Robert Lee Shugars hiding under the bed of the guest room. Shugars initially would not comply with verbal commands, but then started to come out from under the bed slowly. When he did come out, he was brandishing a hammer, which he refused to drop. Shugars was repeatedly told to drop the hammer, but he kept saying angrily that he wanted officers to kill him. One officer stepped on Shugars'hand and made him drop the hammer but he continued to try to get up after he was repeatedly told to put his hands behind his back. The other officer on scene attempted to hold Shugars down by kneeling on his back, but Shugars actively resisted. Shugars was pepper sprayed and was finally taken into custody. Shugars was placed in the patrol vehicle, where he attempted to kick out the passenger side windows and had to be shackled. It was later determined that Shugars had used the hammer to destroy the resident's windshield, two large televisions, a computer monitor and glass table top. The resident was located unharmed. She had escaped through her basement and went to a nearby neighbor?s house. Shugars was charged with felony breaking and entering; a 50b Violation; damage to real and personal property; and resist, delay and obstruct. The magistrate set his bond at $65,000 secured, at which point he berated the magistrate. During his one phone call, he called the victim at her residence and threatened her. Another warrant was therefore issued.
Incident Date: 2008-03-27 12:01:01 Address: 27 CHURCH ST An APD officer responded to an alarm at 27 Church St., location of the Central United Methodist Church. A glass window in the back was broken out and the suspect had gone into the church and disturbed several items, including an empty money box.Damage was done also to an inside glass door. Officers searched the building but no one was located.
Incident Date: 2008-03-23 12:01:01 Address: 74 PINE GROVE AVE Officers were dispatched to a report of gunshots being fired in Erskine Street Apartments at approximately 3:20 a.m. on Sunday, March 23. While officers were en route to the call, a resident at 74 Pine Grove Ave. called 911 to report that a bullet entered the residence through a bedroom wall while residents were sleeping. The caller observed the suspects get into a vehicle and provided a description of same. Officer Josh Rollins located the vehicle traveling north on Pine Grove Avenue and attempted to initiate a vehicle stop, but all 3 occupants ran away from the car. Officer Rollins and Sgt. Ronnie Lance were able to catch one of the suspects, identified as Lawrence Robinson Jr., and he was cited and released to the custody of his grandmother. The other 2 occupants were initially seen by Det. Forrest Weaver. Officers Nathan Anderson, Daniel Reams, and Tanner Rhinehart took the 2 into custody after a foot pursuit through Erskine Street Apartments. Deshone Austin and John Wesley Collins were charged with Second-Degree Trespass and Resist, Delay, Obstruct, respectively. An incident was secured for Firing into an Occupied Dwelling at 74 Pine Grove Ave. Detective Weaver will conduct a follow at a later time. Nothing further to report.
Incident Date: 2008-03-19 12:01:01 Address: 100 ATKINSON ST On March 18 at about 10:30 p.m., APD officers became engaged in a foot pursuit after being dispatched to a drug call near the 27 building of Hillcrest Apartments. A subject ran away from officers toward the 12 building, where he encountered two other officers who were in the process of investigating a separate drug call. The subject continued running, but eventually collided with a parked vehicle and fell to the ground. The subject continued to struggle with officers, but was eventually taken into custody and transported to Mission Hospitals for a laceration to his ear. Nicholas Lamont Ray, birth date 6/28/1976, was charged with resisting officers and was also served with an outstanding for resisting officers. His bond was set at $800 secured.
Incident Date: 2008-03-15 12:01:01 Address: 175 CLINGMAN AVE At about 3:30 a.m. on March 15, APD officers received a call regarding a suspicious vehicle near 175 Clingman Ave., the Silver Dollar Cafe. Responding officers discovered a breaking and entering in progress at the business. A struggle between the suspects and officers ended with a Taser deployment on one suspect. A foot pursuit of the other suspect ended when multiple units, along with a K9 unit, located him. Arrested were Brian Alexander Webster, birth date 7/10/1988, and Timothy Lucas Cagle, birth date 2/1/1971. Both were charged with breaking and entering; possessing burglary tools, resisting arrest; and possession of stolen property (this being a stolen tag on the silver KIA car they were using.)
Incident Date: 2008-03-13 12:01:01 Address: 316 LIVINGSTON ST On March 13, shortly after 11 p.m., Charlie District officers responded to Livingston Street Apartments in reference to an individual discharging a firearm into the air and who was also using a pit bull dog to threaten people. Upon officers? arrival, the complainant advised that the suspect was getting into a maroon colored vehicle and was about to leave the area. Officers located the vehicle and the suspect, Willie Derrick Wilkins, birth date 5-10-1963. He was placed into custody. Upon searching Wilkins, officers located a two-shot Derringer in his front waistband. While conducting the investigation, officers learned that Wilkins was a convicted felon from Washington State. He was charged with the following: possession of firearm by felon; discharging a firearm in the city; and second degree trespassing. Bond was set at $5,500.

Officers Sheehan, Wohleben and Piper located the suspect inside complainant?s truck. Suspect was a Hispanic male with no ID and he would not speak. He was arrested under name of John Doe and charged with the B&E of a vehicle.

Incident Date: 2008-03-07 12:01:01 Address: 100 ATKINSON ST Field Training Officer Griffin and Trainee Fry were entering Hillcrest Apartments to conduct directed patrol activities, they were told by a subject on a moped that there was a fight in progress within the complex. As officers approached the gate house, they spoke with the security guard and as he was in the process of providing additional information, officers heard gunshots being fired in the area of the #10 building. Field Training Officer Griffin and Trainee Fry requested additional units and entered the complex in an attempt to locate the active shooter. As they approached the #28 building, officers heard additional gunshots. Approximately 10-13 gunshots were heard by officers Griffin and Fry. A large crowd was running throughout the complex as officers from all districts arrived on the scene. A sweep of the complex was conducted to look for any injured persons and residents were advised by officers to return home or to stay inside their apartments. All residents, with the exception of one individual, complied with officers requests to do so. This individual (Rahfele Carleaf Rashae Harris, birth date 11/13/86) was verbally abusive to officers and displayed behavior indicative of aggressive action. Officer Freelan therefore utilized his pepper ball gun to gain compliance. Harris then fled into apartment 12-B. Once the complex was secured and no injured persons were located, officers returned to 12-B and took Harris into custody. Harris was charged with failing to disperse on command and with second-degree trespassing. Harris was released on a written promise to appear by Magistrate Lovell. A juvenile who was with Harris was not charged. The juvenile?s mother responded to the scene and he was turned over to her.
Incident Date: 2008-03-03 12:01:01 Address: 100 ATKINSON ST Asheville Police have arrested Joseph Lamar Adams, birth date 02/26/1986, in the March 3 shooting of a man at Hillcrest Apartments, 100 Atkinson St. On Monday, shortly before 9 a.m., Asheville police officers were dispatched to the above address in reference to a gunshot wound. When officers arrived, the victim was waiting in the apartment building?s office with a non-life threatening gunshot wound to his leg. The victim stated that he was shot as he was walking near the #12 building. The victim received medical attention from Emergency Medical Services, but refused transport to the hospital. He gave officers a description of the suspect, who police later determined to be Adams. Adams was arrested today and has been held under a secure bond of $102,000 for the following charges: 1 count of Assault with a Deadly Weapon with Intent to Kill: 2 counts of Driving While License Revoked.",Case Number: 08005988,Address: Not available at this time.,Date: 02/24/2008,"On Feb. 24, Officers responded to a call of a sexual assault on Oakview Road and made contact with the victim. Subject had an outstanding warrant (Felony Probation Violation). Mr. Benjamin had 10.6gm (30 rocks) of crack cocaine in his possession. He was charged with Possession With Intent to Manufacture and Distribute, Schedule II, Possession of Drug Paraphernalia, and Resist, Delay, Obstruct. Bond set at $15,500 secure.

Incident Date: 2008-02-05 12:01:01 Address: 275 SMOKEY PARK HWY Adam units responded to a drug call at the Ramada Inn on Smoky Park Highway. When officers arrived, management advised them that they had received several complaints regarding the traffic in and out of room 139 and that the occupants of the room had been acting suspiciously. Officers met with the occupants of the room and they allowed officers into the room. Officer Biddix located several razor blades with cigar innards in plain view. The two occupants of the room admitted that they had smoked marijuana earlier in the day. Officer Piper noticed two marijuana blunts and a bag of marijuana inside the microwave, through the glass front. The occupants gave consent for the rest of the room to be searched. Officer Piper located a room safe in the back of the room. When he asked the suspects for the key to the safe, the suspects stated that the safe was already locked when they rented the room. Management provided a key for the safe. Officer Piper located $280 and package of crack cocaine inside the safe. Suspect Drawhorn then admitted that he had hid the safe key in his buttocks. Charged were: Robert Antwan Drawhorn B/M 01/15/80 Possession of Schedule VI, Felony PWIMSD Schedule II; John Doe 746 B/M Possession of Schedule VI, Felony PWIMSD Schedule II. Both suspects were out of South Carolina and were held in the Buncombe County Detention Center $10,000 secured bonds.
Incident Date: 2008-02-02 12:01:01 Address: 50 WILBAR AVE On 02/02/2008 at 1857 hours, Officers were dispatched to a fight in progress call with a man down at 50 Wilbar Ave (Lee Walker Heights) in the middle parking area. Housing Unit Lt. Young arrived first and said everything was cleared from the middle parking lot. Officer Torgow arrived and was flagged down by other involved Ms. Hicks. Ms. Hicks said the victim, Ray Dean Cagle, was sitting behind the number 14 building. Officer Torgow located the victim and called for emergency paramedics to respond reference a 2 inch laceration above the left eyebrow and severe swelling to the facial area.

Incident Date: 2008-01-19 12:01:01 Address: 79 ASHELAND AVE Common Law Robbery at M&J Food Mart, Old Haywood Road: Police advised that a white male entered the store wearing a black hood jacket, white gloves, sunglasses and a white scarf over his face. He approached the counter demanding money, but the clerk assumed that this was joke and didn?t respond. The suspect became angry and demanded the money again and stepped closer to the counter and repeated the demand. The clerk was removing the money and the suspect became very impatient starting grabbing the money from her hand then left the store. The clerk activated the alarm then approached the door to get a better description of the suspect. The suspect left on foot headed east on Old Haywood Road and entered into a light colored vehicle. Suspect was not apprehended. No weapon was shown. Amount of cash taken was $868.
Incident Date: 2008-01-15 12:01:01 Address: 805 PATTON AVE Going Armed to Terror of Public; Damage to Property reported at Blockbuster, Patton Avenue: Witnesses said a white male suspect entered the business accompanied by an older white female. The suspect walked toward the first movie rack when suddenly there was very loud bang. Witness approached the suspect and noticed a hole in the carpet. Suspect explained the he threw a loud popper to the floor and offered to pay for the damages. The female approached the suspect and said something to him. The two left quickly through the front door. The suspect dropped a handgun on the ground from his jacket pocket. The suspect retrieved the gun and the two got into a vehicle parked in front of Tan Universe, located in the same shopping center. The female drove westbound on Patton. Suspect is described as being a white male in his 20s, about 6 feet tall and with short brown hair with a thin beard and mustache. The jacket has black lettering trimmed in red on the back. The vehicle was described as a Silver Nissan two-door. The witnesses found a live .38 caliber special round on the floor near the hole in the carpet and a spent shell found under the movie rack. No one apprehended at this time.
Incident Date: 2008-01-09 12:01:01 Address: 1069 SWEETEN CREEK RD Officer Anderson was traveling past the Hot Spot on Sweeten Creek Road when he noticed a fight taking place in the parking lot. Officer Anderson pulled into the lot and secured two subjects and two more ran away. Officer Muse responded and caught the third subject, but the fourth person got away. The suspects were all striking and hitting a fifth person who was later determined to be a victim. The suspects were in fact attempting to rob the victim of his cell phone and money. Three subjects were charged with the robbery and assault. CID and ID responded. Officer Anderson took out the warrants and is working the case.
Incident Date: 2008-01-05 12:01:01 Address: 10 ALEXANDER DR AT: 532 At 3:07 a.m. Jan. 5, APD received a call to Woodberry Aparments, 10 Alexander Drive, in reference to report of gunshots in area.
Incident Date: 2008-01-04 12:01:01 Address: 280 LIVINGSTON ST AT: A Home invasion reported Jan. 4 at 280 Livingston St. Victims said the suspects were three black males with guns and their faces covered by bandanas. The suspects took cell phones and other items and left the area in an unknown direction and manner. One victim was hit in the head with a gun and so all 5 people inside the house left and went to Mission Hospitals and called the police from that location. CID and ID responded to the hospital and then back to the house.
Incident Date: 2008-01-03 12:01:01 Address: 3 S TUNNEL RD Armed robbery reported on Jan. 3 under the parking deck near the food court at the Asheville Mall.
Incident Date: 2007-12-19 12:01:01 Address: 1 GRANADA ST AT: 29H Officers Biddix, Piper, Sheehan and Allen were conducting crime prevention efforts on foot in both Deaverview and Pisgah View apartments, when Officer Biddix noticed Allen Keith Gilliam, black male, birth date 5/6/74, with something in his hand. Gilliam turned and ran into apartment 29H at Pisgah View. Officer Biddix located the suspect entering the kitchen. Once the suspect was in custody, Officer Biddix noticed a digital scale on the front window sill. As Officer Biddix was questioning Gilliam about the scale, Officer Piper noticed a small foil packet on top of the television. Officer Piper found .5 grams of crack cocaine inside the packet. Officers Biddix and Allen located a large Christmas plate with a razor blade on it in the kitchen. Both the plate and razor were covered in cocaine residue. The other tenant of 29H arrived on scene and was placed in custody. A small bag of marijuana and another razor blade was found on his person. Incident Date: 2007-12-18 12:01:01 Address: 133 LIVINGSTON ST A Pisgah View resident reported that on 12/18/07 he was driving his car west on Livingston Street when he passed a large four-door gold car going in the opposite direction. This vehicle was occupied by four or five younger black males and one rolled down a driver?s side window as the cars passed. The resident heard something hit the rear of his car and looked into his mirror to see a suspect hanging out the gold car?s window, pointing a silver handgun toward his car. The resident stated that he drove home, as he was afraid to stop in that area. Officer J. Spinda found a bullet hole in the man?s trunk lid. ID responded for pictures and recovered a bullet from inside the trunk.
Incident Date: 2007-12-16 12:01:01 Address: 651 SMOKEY PARK HWY At 1930 hours, officers were dispatched to 651 Smoky Park Highway, Crossland Homes in reference to a burglar alarm. Officers Taube, Sheehan and Sgt. Creson responded and found a white male, Donnie Lee Allison, birth date 11-24-1973, hiding in a bedroom behind a couch. He was arrested for misdemeanor burglary, and two warrants were served for driving while license revoked and failure to register vehicle. Allison also had a set of master keys that were stamped Luv Homes (Fletcher) and these were placed into APD property. The manager responded and was very thankful and she stated that last week they were broken into and appliances were stolen. Small damage was made to the door to gain entry to make the arrest. Internal incident report completed with ID taking pictures. Officers also found a total of four buildings open and searched them.
Incident Date: 2007-12-16 12:01:01 Address: 669 HAYWOOD RD At 2034hrs Charlie District (Central/South) units responded to the Ingles on Long Shoals Road in reference to assisting the Adam District (West) in an armed robbery that had occurred at 669 Haywood Road. Charlie units met the victim there and helped attempt to locate the suspect vehicle and helped secure the report.

The victim stated that two black males approached him, one with a gun, and asked for his wallet and money. The victim gave the suspects his wallet and then the suspects fled the scene on foot.
